SAFETY GUIDELINES, ACCEPTANCE OF RISK AND WAIVER OF LIABILITY
(“Safety Guidelines and Release”)

Apollo Pet Services Inc.’s
(also known as “Apollo Indoor Dog Park and Coffee Bar”) indoor off-leash dog arena

Apollo Indoor Dog Park and Coffee Bar (hereinafter referred to as “Apollo”) operates a dog-friendly coffee bar with a dedicated dog arena for off-leash activities (hereinafter the “Dog Park”). Customers can obtain access to the Dog Park by purchasing a membership or packages containing entrance credits (hereinafter the “Members” or individually a “Member”). Apollo is committed to providing programs and services in a safe manner and continuously strives to minimize risks for its Members. As such, the Members of the Dog Park are required to follow the safety rules and instructions disclosed hereinbelow. All Members of the Dog Park must understand the inherent and unpredictable risks of injury and damage associated with the use of the Dog Park.

Each person attending the Dog Park as a Member, or guests of the Member, must submit a completed and signed copy of this form or they will not be permitted to enter the Dog Park. By signing this waiver, you freely and voluntarily agree to follow the safety guidelines. Please read and complete this waiver carefully.

Article 1: SAFETY GUIDELINES

Section 1: Vaccination Requirements

As a condition to entering the Dog Park, all dogs must have the following vaccinations: (i) Rabies; (ii) DGPP (Distemper, Hepatitis, Parainfluenza and Parvovirus); and (iii) Bordetella. Proof of vaccination will be required prior to obtaining access to the Dog Park whether by membership or packages. It is the Member’s obligation and responsibility to ensure their dog(s) have the above-mentioned vaccinations. In the case of a vaccination renewal, the Member must ensure that the vaccination was administered at least ten (10) days prior to entering the Dog Park.

Section 2: Temperament Assessment

Prior to receiving access to the Dog Park, the Member’s dog(s) must go through a temperament screening test. Apollo shall conduct the test to evaluate if the dog demonstrates aggressive behaviors. Should the dog fail the temperament test, access to the Dog Park shall not be granted. To safeguard the ongoing security of the Dog Park, Apollo reserves the unequivocal right to terminate a dog's access forthwith at any point, should the dog exhibit three (3) or more instances of minor aggression, as observed and determined by Apollo in its sole and absolute discretion. In the event that a dog displays any form of severe aggressive behavior, Apollo shall have the absolute discretion to immediately and effectively revoke the dog's access to the Dog Park.

Section 3: Fleas and Ticks

All dogs entering the Dog Park must be flea and tick free. Dogs with signs of ticks and/or fleas will not be permitted to enter the Dog Park. It is the Member’s responsibility to recognize the signs of ticks and/or fleas and ensure their dog is not a carrier of said parasites prior to entering the Dog Park. Apollo reserves the right to deny entry, at their sole discretion, if a dog has any signs of ticks and/or fleas.

Section 4: Illness

All dogs entering the Dog Park must be in good and healthy condition. Dogs with signs of illness will not be permitted to enter the Dog Park. Members shall exercise due diligence in monitoring their dogs for any indications of illness and are obliged to refrain from bringing their dogs to the Dog Park in the event that any such symptoms are observed. Symptoms include but are not limited to cough, excessive mucus, diarrhea, vomiting, shortness of breath, and other signs of illness. Apollo reserves the right to deny entry, at their sole discretion, to ensure the safety of all its Members and their dog(s).

Section 5: Food and Beverages

Food and beverages are not permitted in the Dog Park. In order to avoid any negative situations, such as but not limited to, spills and messes, and conflicts over resources such as dogs taking food items from Members, all Members shall be responsible to ensure they do not bring food and/or beverages into the Dog Park, including dog food and/or dog chews. Notwithstanding the foregoing, training treats and sealed beverage containers shall be permitted.

Section 6: Members’ Guests

All Members shall be permitted to bring a maximum of (___) guests to the Dog Park. However, any guest under the age of thirteen (13) must be accompanied by an adult at all times. Infants under the age of three (3) will not be permitted in the Dog Park as a security precaution. The Member shall be responsible for informing their guest of the inherent risks of injury and/or damage associated with the Dog Park. Further to this, the Members must ensure that their guests acknowledge, understand, and comply with all the rules of the Dog Park stipulated herein.

Section 7: Emergency Procedures

In the event of an emergency within the premises of the Dog Park, including but not limited to, instances of dog fights or medical emergencies involving either a dog or a person, the following procedures shall be immediately enacted to ensure the safety and well-being of all Members, guests, and animals present:

  • A - Notification: Any Member, guest, or employee who observes or becomes aware of an emergency situation must promptly notify Apollo staff on duty. Apollo will maintain a visible and accessible list of emergency contacts, including local veterinary hospitals, animal control, and emergency medical services.
  • B - Intervention: Apollo staff are trained to efficiently intervene in emergencies. In the case of a dog fight, staff will employ non-violent methods to separate the animals safely. Under no circumstances shall Members or guests attempt to physically intervene in dog fights or other dangerous situations.
  • C - Medical Assistance: For emergencies involving injury to a person or a dog, Apollo staff will provide first aid and call for medical assistance or veterinary care as required. A first aid kit for both humans and dogs will be available on site. Apollo will also have direct communication means to contact emergency medical services and veterinary clinics for immediate response.
  • D - Evacuation: Should it become necessary to evacuate the Dog Park, Apollo staff will direct Members and guests to the nearest safe exit as per the evacuation plan posted within the Dog Park area.
  • E - Incident Report: Following any emergency, an incident report must be completed by Apollo staff. Members and guests involved in or who have witnessed the emergency are encouraged to provide their account of the event to ensure a comprehensive understanding of the circumstances. This report will be used for insurance purposes and to implement measures to prevent future incidents.
  • F - Follow-Up: Apollo commits to a thorough follow-up on all emergencies, including providing support to affected Members and guests, reviewing and updating emergency procedures, and communicating with Members about any changes to policies or procedures as a result of the incident.

Apollo prioritizes the safety of its Members, guests, and their dogs. By adhering to these Emergency Procedures, together we can ensure a swift and effective response to any emergency situation that may arise within the Dog Park.

Article 2: ACKNOWLEDGMENTS AND REPRESENTATIONS

Section 1: Acknowledgments and Assumptions of Risks

I acknowledge that by voluntarily choosing to enter the Dog Park, I am willingly exposing myself, my guests, and my dog(s) to potential risks that may arise despite Apollo's stringent safety measures. These risks encompass, but are not limited to, unforeseen accidents, health issues, the possibility of a female dog becoming pregnant, personal injuries or even fatalities involving myself, my guests, or my dog(s), as well as potential damage to personal belongings. This also includes potential emergencies, exposure to the reckless conduct of other individuals or dogs, or the possibility of negligence from other Members or their guests. It is with full awareness of these risks, including the chance of property damage and personal injury to myself, my guests, and my dog(s), that I voluntarily agree to accept and fully bear all such risks.

Section 2: Member’s Responsibility and Obligations

I understand the rules stated herein and agree to comply with all rules and signage to, from, and at the Dog Park and surrounding areas.

All Members are responsible for their dog(s) and their behavior, and to ensure that said dog(s) behave adequately in the Dog Park.

As such, I understand that I am solely responsible for any harm caused by my dog(s) while my dog(s) is/are attending the Dog Park. I assume all responsibility and liability for any damages, sickness, pregnancies, loss, death, or injury caused directly or indirectly by my dog(s) to any person, animal, or object.

I acknowledge and confirm that, by granting my dog(s) access to the Dog Park, Apollo is acting in reliance upon my assurance that my dog(s) are in a state of good health, free from any communicable diseases, and have received all required vaccinations.

I understand that in no case shall Apollo, its members, officers, directors, employees, agents, attorneys, contractors, and their respective heirs, successors, executors, administrators, and assigns (hereinafter referred to as the “Releasees”) be considered the temporary custodians of my dog(s). My dog(s) shall not in any case be considered in the care or control of Apollo and/or its Releasees. I understand that my dog(s) shall remain my responsibility for the entire duration spent in the Dog Park and or surrounding areas of the coffee bar, even if I leave my dog(s) unattended in the Dog Park. I understand and agree that Apollo strongly recommends not leaving my dog(s) unattended. I further understand and agree that Apollo and its Releasees are not liable for any problems that develop, and I hereby release Apollo of any liability of any kind whatsoever arising from my dog(s) attendance and participation at the Dog Park.

I understand that it is my responsibility to inform my guest(s) of the assumed risks in the Dog Park along with the rules and obligations of the Dog Park. I further understand that I must ensure my guest(s) comply with all the rules and obligations of the Dog Park. Should any of my guest(s) violate the aforementioned rules and obligations, Apollo reserves the right to temporarily revoke my access to the Dog Park, and my guest(s) may be prohibited from future entry, at the sole and exclusive discretion of Apollo.

Section 3: Amendments

Apollo reserves the right to amend, change, or create these and other rules which may be posted online. Should you no longer agree with the modified and/or new rules and wish to revoke your acceptance of said rules, you must do so in writing to Apollo. In this case, your access to the Dog Park may be revoked, at Apollo’s sole and exclusive discretion.

Section 4: Indemnity

I understand and agree to defend, indemnify, and hold Apollo and its Releasees harmless against any and all claims, suits, costs, loss, damage, liability, or expense that may arise due to my own and/or my dog(s) attendance and participation at the Dog Park.

Section 5: Revocation of Access to the Dog Park

I acknowledge that Apollo reserves the right to suspend, permanently or temporarily, my access to the Dog Park, at their sole discretion for any breach of the stipulations contained herein.

Article 3: Limitations

I hereby acknowledge and accept that, in accordance with the Civil Code of Quebec, a party may only seek compensation for damages that are immediate and directly attributable to the fault of Apollo. Such damages are limited to those that were foreseeable at the time of the incident, except in cases of intentional misconduct or gross negligence.

Notwithstanding any other provision of this Safety Guidelines and Release, and irrespective of the foregoing, in the event Apollo is deemed liable to a Member or their guest(s), the aggregate liability of Apollo towards the Member and/or their guest(s) shall be strictly limited to the total amount of fees actually paid by the Member to Apollo under the terms of their membership and/or package for entrance credits. This limitation of liability shall apply to all claims, losses, and damages of every kind and nature, whether known or unknown, arising out of or in any way connected with the Dog Park.

Article 4: Protection of Personal Information

Apollo collects personal information from the person signing the present Safety Guidelines and Release. The personal information being collected is limited to the name, phone number, and email of the said person. I acknowledge that Apollo will collect this personal information only when I voluntarily provide it and this information will be maintained in accordance with applicable data privacy laws. Personal information is digitally stored by Apollo. Apollo will only use, disclose, or retain personal information for as long as is necessary to achieve the purposes for which it was collected and to the extent permitted or required by applicable law. I understand that I have rights of access and rectification regarding my personal information, and I may withdraw my consent at any time. If I have any questions regarding my personal information or the above procedure, I can contact the President of Apollo, Josephine Friedman, at josephinef@apollodogpark.com.

Article 5: Governing Law

These Safety Guidelines and Release and the rights and obligations of the parties hereunder shall be governed by and construed in accordance with the laws of Québec. The parties hereby agree that all suits, actions, proceedings, disputes, or claims relating to or arising out of these Safety Guidelines and Release shall be brought and heard before a Court in the Province of Québec.

Article 6: Consent

I acknowledge that I have received, read, and understood the Safety Guidelines and Release and that Apollo will only use my personal information for the purposes and in the manner described above.

I voluntarily accept the contents of this Safety Guidelines and Release and agree to the safety guidelines, terms, and conditions stated above.

I, THE UNDERSIGNED, hereby express my desire to participate in Dog Park activities and I have received, read, and understood these Safety Guidelines and Release.

ANNEXE A – CAMERA AND PHOTO RELEASE

Dog Park Security Monitoring and Streaming

Apollo uses surveillance cameras in the Dog Park primarily for security purposes and to allow the Members to watch their dogs via the streaming link available to them. I acknowledge that Apollo uses cameras in the Dog Park which are live-streamed and accessible to the Members for their viewing. I understand that by entering the Dog Park I shall appear in the live stream.

I hereby consent to being recorded in the Dog Park and appearing on the Apollo Dog Park live stream accessible by its Members.

I understand that if I do not consent to the above, I may not be permitted to enter the Dog Park and I may not be permitted to receive membership and/or packages to gain access to the Dog Park. 

I understand that my consent can be revoked at any time by written notice sent by email to the President of Apollo, Josephine Friedman, at josephinef@apollodogpark.com.

Photo Release 

By attending Apollo and the Dog Park, I acknowledge that Apollo may periodically capture photographs and videos of the Dog Park, dogs and/or its Members. These images and videos will be used exclusively for marketing and promotional purposes related to Apollo’s activities. 

I hereby agree and consent to the distribution and use of all photographs, images and videos on which I may appear for the purpose of disseminating information about Apollo and for promotional use in general. I expressly authorize Apollo to capture images on film, videotape, or through any other technical or electronic means, to use and reproduce images in newspapers, flyers, poster, leaflets, brochures, press kits and submissions to journalists, websites, social media sites, including social media stories, social media posts, reels and any other digital communication or in any other way. 

Should you have any concerns regarding the use of your likeness or that of your dog(s), you may contact the President of Apollo, Josephine Friedman, at josephinef@apollodogpark.com.

I understand that if I do not consent to the above, I may not be asked to leave the Dog Park when Apollo intends on taking or is taking pictures and/or videos of the Dog Park, the dogs and/or Members. In such cases, it will be my responsibility to ensure that I remove myself from any areas where such photography or videography is occurring.  

I understand that my consent can be revoked at any time by written notice sent by email to the President of Apollo, Josephine Friedman, at josephinef@apollodogpark.com.
